  • In complex cases, we use a digital evidence management platform to streamline the work and to sort, categorise and comment on evidence. We have seen that this allows us to become familiar with complex projects more quickly, enabling us to provide our clients with clear advice at an early stage.
  • When we have a sufficient overview of a case, we can calculate the estimated value of the claim or risk exposure, in the event that our client has received a claim. In our experience, such valuations (probability-weighted expected value) give our clients much better grounds for decision-making, compared to the use of concepts such as a “good”, “bad” or “arguable” case.
  • The final stage of the initial phase is to use the review of the facts and the valuations to work out a strategy that ensures that the client’s goals can be achieved.

Our team also has extensive experience in settlement negotiations and mediation, and handles an increasing number of such cases. In addition, we are an industry leader in provisional security (arrest and temporary injunction) and the securing of evidence outside of trial.
